의사표시의 공시송달 신청하기

✔ 민법 제 113조는 표의자가 과실 없이 상대방의 소재를 알지 못하는 경우에는 민사소송법 공시송달의 규정에 의하여 의사표시를 송달할 수 있다고 정하고 있습니다.

✔ 임대인이 내용증명을 받지 않거나 연락이 닿지 않을 경우, 법원에 의사표시의 공시송달을 신청하는 절차를 통해 임대인에게 계약해지의 의사를 통지하고 임대차보증금의 반환도 요구하는 효과를 얻을 수 있습니다.
